These Terms of Service (“Terms”) govern your use of Mentioflow (the “Service”) operated by Mentioflow (“we”). By creating an account or connecting an Instagram account, you agree to these Terms.
1. The Service
Mentioflow provides software that connects to Instagram Business and Creator accounts via the Meta Platforms API to automate comment-to-DM responses, capture leads, and provide analytics. The Service depends on third-party platforms (Instagram, Meta) and is subject to their availability and policies.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and authorised to bind the entity you represent. You must comply with all laws and the Instagram Platform Policy and Meta Community Standards when using the Service.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at mentioflow@gmail.com of any unauthorised use.
4. Acceptable use
You agree not to:
- Send messages that are unsolicited, harassing, deceptive, illegal, or that violate Meta’s policies including the prohibition on spam.
- Use the Service to scrape, resell, or republish data beyond the scope of your authorised use.
- Use the Service to circumvent Instagram’s rate limits, attempt to evade detection, or impersonate any person or entity.
- Attempt to disrupt, reverse-engineer, or probe the Service for vulnerabilities outside a written agreement with us.
We may suspend or terminate accounts that violate this section, with or without notice, including to comply with Meta’s requests.
5. Plans, billing, and refunds
Paid plans renew automatically at the end of each billing cycle unless cancelled before renewal. You can cancel any time from Settings → Billing; the cancellation takes effect at the end of the current cycle.
Refunds are governed by our Refund Policy, which offers a 7-day money-back guarantee for first-time paid subscriptions and otherwise treats fees already paid as non-refundable. Indian customers retain all rights under the Consumer Protection Act, 2019.
6. Customer data
Data you submit, and Instagram data you authorise us to access, remains yours. You grant us a limited, non-exclusive licence to process that data solely to provide the Service, as described in the Privacy Policy.
7. Intellectual property
We retain all rights in the Service, including the software, designs, and trademarks. You may not copy or modify the Service outside the rights granted in these Terms.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, nor that the Service will achieve any particular result.
9. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability arising out of or related to these Terms will not exceed the amount you paid us in the 12 months preceding the event giving rise to liability.
10. Indemnity
You will defend, indemnify, and hold harmless Mentioflow against third-party claims arising from your breach of these Terms or your misuse of the Service.
11. Termination
Either party may terminate the agreement at any time. On termination we will, at your request, delete your data within 30 days (subject to legal retention requirements). Sections that by their nature should survive termination, will (e.g., 6, 8, 9, 10, 13).
12. Changes
We may update these Terms; we will post the updated version here and, for material changes, notify you by email. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of [jurisdiction placeholder], without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located in [jurisdiction placeholder].
